Terms of Service

1. Acceptance of terms

By accessing and using TenderFinder ("the Service"), a registered business name operating in Australia (ABN 52 661 243 947), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. About TenderFinder

TenderFinder is an independent information aggregation and AI-assisted bid response platform. We are not affiliated with, endorsed by, or connected to the Australian Government, the Department of Finance, AusTender, or any state or territory procurement portal. We provide a convenience service only.

3. AI bid response disclaimer

The AI Bid Response Generator uses Claude (by Anthropic) to produce draft tender responses based on information you provide. By using this feature, you acknowledge and agree that:

  • All AI-generated content is a draft starting point only. You are responsible for reviewing, editing, and verifying the content before submission.
  • The AI may produce inaccurate, incomplete, or inappropriate content. You must cross-check all claims, figures, and compliance statements against the original tender documents.
  • TenderFinder makes no warranty that an AI-generated response will win any tender, satisfy any evaluation criteria, or comply with any procurement rules.
  • You are solely responsible for the accuracy of business information you provide (ABN, certifications, past projects, personnel details). Submitting false or misleading information to a government agency may constitute an offence.
  • Where the response contains "[ACTION REQUIRED]" or "[INPUT REQUIRED]" placeholders, you must replace these with accurate information before submitting.
  • Always download the final tender documents from the official source (AusTender or the relevant portal) and verify all requirements before submitting your response.

4. Pricing and payments

The AI Bid Response Generator is a paid service. Pricing is as follows:

  • Simple (RFQ / low-complexity) — $99 AUD
  • Standard (most RFT contracts) — $149 AUD
  • Complex (large or multi-criteria tenders) — $249 AUD

All prices are in Australian dollars and include GST where applicable. Payments are processed securely by Stripe. A receipt will be sent to the email address you provide at checkout.

5. Refund policy

We offer a 48-hour satisfaction guarantee on the AI Bid Response Generator. If you are not satisfied with the generated bid response for any reason, you may request a full refund by emailing refunds@tenderfinder.com.au within 48 hours of receiving the generated document, quoting your order reference.

Refund requests within this window are honoured on a no-questions-asked basis. We will not decline a refund request based on whether the bid response has been downloaded or used.

Refunds are processed within 5 business days of email confirmation. If generation fails due to a technical error on our side, a full refund will be issued automatically without requiring a request.

Nothing in this refund policy limits your rights under the Australian Consumer Law.

6. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they are not of acceptable quality and the failure does not amount to a major failure.

7. Accuracy of tender information

Tender data is sourced from AusTender and is updated automatically every 30 minutes. While we endeavour to keep information accurate and current, TenderFinder does not warrant the completeness, accuracy, or timeliness of any tender data displayed. Always verify tender details on the official government source before submitting a bid.

8. Permitted use

You may use TenderFinder to search and browse government tender opportunities, subscribe to alerts, and generate bid responses for your own business. You must not:

  • Scrape, copy, or redistribute tender data in bulk for commercial purposes.
  • Use the AI Bid Response Generator to generate responses for businesses you do not represent without their express consent.
  • Resell or sublicense AI-generated content as your own product or service.

9. Intellectual property

Tender data is sourced from AusTender under the Creative Commons Attribution 3.0 Australia licence (© Commonwealth of Australia). AI-generated bid responses are provided to you for your use; TenderFinder makes no claim to ownership of the output. The TenderFinder platform design, code, and original content are the property of TenderFinder (ABN 52 661 243 947).

10. Limitation of liability

To the maximum extent permitted by Australian law and subject to your rights under the Australian Consumer Law, TenderFinder excludes all liability for loss or damage arising from use of the Service, including but not limited to: loss of profits, failure to win a tender, or reliance on AI-generated content without independent verification.

11. Governing law

These Terms of Service are governed by the laws of the Australian Capital Territory, Australia. Any disputes arising from use of the Service shall be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.

12. Changes to these terms

We may update these Terms of Service from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
